Post a video testimonial on youtube.com regarding your personal or professional experience with the IonCleanse® foot bath by A Major Difference between now and December 31, 2009 and you will be entered into a drawing to win one of five prizes including a brand new IonCleanse® Premier™.

Here’s how to enter:

1. During the Contest Period (see below), post a video on your personal youtube.com account discussing a positive experience, protocol, or testimonial regarding the IonCleanse® foot bath or why you would like to own an IonCleanse® foot bath. You do not need to be an owner of an IonCleanse® foot bath to enter.
2. Allow your video to be shared and embedded (see youtube.com for details).
3. Send a link (URL) of your video to social@amajordifference.com along with your full name, postal address, email address phone number and age with the subject matter of the email stating “IonCleanse Video Contest” by 11:59 PM EST on December 31, 2009.   Video must remain on YouTube.com until 11:59 PM EST on December 31, 2010.
4. Video: (i) must be between thirty (30) seconds and five (5) minutes long; (ii) must be in English; (iii) must reference “IonCleanse® by A Major Difference” least one (1) time and (iv) title must include “IonCleanse® ionic foot bath video submission.” Names, dates, places, etc. can be added to the title as long as the aforementioned title is intact.

Eligibility: No purchase is necessary to enter or claim prize. The IonCleanse Premier Contest (the “Contest”) is open to all legal U.S. residents who are at least eighteen (18) years of age. Employees of A Major Difference Inc. (“Sponsor”) and its respective parent companies, subsidiaries, affiliates, suppliers, advertising agencies, and the families and persons living in the same household as such employees, are not eligible to participate. The Contest is subject to all federal, state, and local laws. Void where prohibited or restricted by law or regulations.

Contest Period:  The Contest begins at 12:01 AM EST on September 14, 2009 and ends at 11:59 PM EST on December 31, 2009 (“Contest Period”).

5) Videos must not: (i) feature or refer to any other foot baths other than IonCleanse®; (ii) feature or reference other third party trademarks (with the exclusion of “IonCleanse® by A Major Difference”); (iii) feature or reference any third party logos; (iv) contain any copyrighted works (other than as owned by the entrant); (vi) include any music (unless the original music of entrant); (vii) contain vulgar, obscene,  indecent or pornographic language or behavior; (viii) defame or libel any third party, or (ix) violate a third party’s privacy rights.  By uploading the video, you agree that you have received permission for the use of the image/likeness of any and all identifiable persons appearing in your entry. You may be required to submit a release (to be provided by Sponsor) signed by each identifiable person appearing in your entry granting Sponsor permission to use his or her image/likeness. Entries that do not comply with these Official Rules or that otherwise contain prohibited, or inappropriate content as determined by the Sponsor, in its sole discretion, will be disqualified and will not be published or considered for prizes. Sponsor makes the final determination as to which entries are eligible to take part in this Contest and be considered for a prize.

Entries will not be returned or acknowledged. In the event of a dispute over the identity of an entrant, entry will be deemed submitted by the authorized account holder of the e-mail account of the e-mail address submitted at time of entry. “Authorized account holder” is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.

Selection of Winners: Winners will be determined in a random drawing on or about January 11, 2010 (from among all eligible entries submitted during the Contest Period) conducted by representatives of Sponsor, whose decisions are final and binding in all matters relating to this Sweepstakes. Winners will be notified by telephone, mail or e-mail on or about January 13, 2010, and will be given instructions on how to claim prize. Each winner will be required to sign and return an affidavit of eligibility and liability release (and, where permitted, a publicity release) within fourteen (14) days of notification or prize will be forfeited and awarded to an alternate winner. Odds of winning depend on the number of eligible entries received.

Prizes (5): One (1) grand prize winner will receive a new IonCleanse® Premier™.   ARV: $2895.  One (1) first prize winner will receive one (1) case of 304/321 plates.  ARV: $960.  One (1) second prize winner will receive one (1) case of 316 plates.  ARV: $660.  One (1) third prize winner will receive a Winchester Level 1 Seminar DVD.  ARV: $149.  One (1) fourth prize winner will receive two (2) sets of 316 replacement plates.  ARV: $140.   Winners will be responsible for all expenses not specifically included herein, and all applicable federal, state and local taxes. Prize is non-transferable and winners are permitted to substitute prize for Sponsor credit only.  Sponsor reserves the right to substitute prize for one of equal or greater value.

Release of Liability: By participating, you release Sponsor and its subsidiaries, affiliates, partners, employees, directors, agents, advertising agencies, and all other associated with the development and execution of this Contest (“Released Entities”), from any and against any and all injury, loss or damage caused or claimed to be caused by your participation in the Contest and/or the acceptance, awarding, receipt, use and/or misuse of the prize, and you agree that the Released Entities are in no matter responsible for any warranty, representation, or guarantee, expressed or implied, in fact or in law, relating to the Contest and/or the awarding of any prize.  Notwithstanding the foregoing, in the event that the preceding release is determined by a court of competent jurisdiction to be invalid or void for any reason, Contest entrant agrees that, by entering the Contest, (i) any and all disputes, claims, and causes of action arising out of or in connection with the Contest, or any prizes awarded, shall be resolved individually without resort to any form of class action; (ii) any claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Contest, but in no event attorney’s fees; and (iii) under no circumstances will any entrant be permitted to obtain any award for, and entrant hereby waives all rights to claim, punitive, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than damages for actual out-of-pocket expenses.

Additional Rules: Entrant represents and warrants that his/her entry: (i) is the original work of the entrant produced for this Contest; (ii) has not been entered in or won previous contests or awards;  (iii) has not been published previously in any medium; (iii) does not infringe any party’s intellectual property rights; (iv) does not contain indecent, obscene or pornographic material; (v) does not contain defamatory statements (including but not limited to words or symbols that are widely considered offensive to individuals of a certain race, ethnicity, religion, sexual orientation or socioeconomic group); (vi) does not include threats to any person, place, business, group or world peace, (vii) does not invade privacy or other rights of any person, firm or entity, and (viii) does not in any other way violate applicable laws and regulations.

By entering this Contest and uploading your video, you irrevocably grant to Sponsor and its agents the unconditional and perpetual right to post, display, publish, use, adapt, edit and/or modify such video in any way, in any and all media, for any purpose, without limitation, and without consideration to you. Winners agree to irrevocably assign and transfer to the Sponsor any and all rights, title and interest in their winning video, including, without limitation, all copyrights and waive all moral rights in the video.

Entrant hereby agrees to defend, indemnify and hold harmless Released Entities against any and all third party claims, damages, liabilities, costs and expenses, including reasonable legal fees and expenses, arising out of or related to any breach by the entrant of any provision of these Official Rules, including, without limitation, entrant’s representations and warranties made herein.

Sponsor is not responsible for: (i) lost, late, misdirected, damaged, garbled or illegible entries; (ii) error, omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions of any kind, or inaccurate transmission of or failure to receive entry information by Sponsor on account of technical problems or traffic congestion on the Internet or at any web site or any combination thereof; or (iii) any injury or damage to entrant’s or any other person’s computer related to or resulting from participating in the Contest.  Sponsor reserves the right to: (i) permanently disqualify from any contest it sponsors any person it believes has intentionally violated these official rules; and (ii) suspend, modify or terminate the Contest if Sponsor believes, in its sole discretion, that malfunction, error, disruption or damage is impairing or will impair the administration, security, fairness, integrity of the Contest. If Contest is terminated before the end date, Sponsor will determine the winners via a random drawing from all eligible entries received as of the termination date. Sponsor reserves the right to disqualify any unauthorized entries. Entering the Contest constitutes permission to the Sponsor to use the name, voice, and likeness of the winner along with the winning video for advertising and publicity purposes, without further compensation.

LEGAL WARNING: ANY ATTEMPT BY AN INDIVIDUAL, WHETHER OR NOT AN ENTRANT, TO DELIBERATELY DAMAGE, DESTROY, TAMPER OR INTERFERE WITH THE OPERATION OF THE CONTEST, IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND DILIGENTLY PURSUE ALL REMEDIES AGAINST ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.
